JOHN F. MALONEY has actively engaged in civil and commercial litigation and corporate disputes for the past 35 years. He is certified in Civil Trial Advocacy by the National Board of Trial Advocacy.
John received his bachelors degree from Marquette University in 1969 and graduated from the University's Law School in 1972. From 1972 until 1988, John was a member of a large Milwaukee law firm, becoming a shareholder in 1975. John focused his practice in the areas of civil and municipal litigation and has extensive appellate experience. Based upon his experience in significant cases, John also authored law journal articles on Wisconsin's public record and open meeting laws and on the right to solar access as an alternative energy source.
John has participated in a number of complex business disputes and personal injury actions, including the successful defense of aircraft manufacturers in product liability actions and has prosecuted several drug product liability actions in which multi-million dollar settlements were reached. John has served as national class counsel in various class actions filed here in Wisconsin. He was also lead counsel in the successful defense of a Lanham Act (deceptive advertising) claim, BASF Corporation v. The Old World Trading Company, in the U.S. District Court for the Northern District of Illinois. The plaintiff sought damages of approximately $49.5 million, plus enhancement and punitive damages. That six-week trial resulted in a recovery limited to $2.4 million in lost profits.
John is admitted to practice in both Wisconsin and Illinois and is a member of the Wisconsin and Illinois State Bar Associations. He has also litigated and tried cases in the U.S. District Courts in the Eastern and Western Districts of Wisconsin, the Northern District of Illinois and the Central and Northern Districts of California. At the appellate level, John has briefed and argued cases before the Wisconsin Court of Appeals and Supreme Court, as well as in the U.S. Court of Appeals for the Seventh Circuit.
